Policy

  1. Regulation
    No person shall import or export shell eggs classified as loss, inedible, or incubator rejects unless they are denatured or decharacterized and identified as required by 7 CFR 57

    Loss and inedible eggs shall be crushed and shall be placed in a container containing a sufficient amount of approved denaturant or decharacterant, such as FD&C brown, blue, black, or green colors, meat and fish by-products, grain and milling by-products, or any other substance, as approved by the Administrator, that will accomplish the purposes of this section (7 CFR 57.720 (a)(2)(i))
     
  2. Product Labeling
    Product labeling, with all required information, must be clear, legible, and conspicuous. The shipping container shall bear the packer’s full name and address, and the statement “Inedible Eggs – Not to be Used as Human Food”. Product labeling must appear in a central location on the end of every case, barrel, tote, or other final container.
     
  3. Certification
    Graders shall include the following in the remarks section of the LP-210S Certificate:
    • The statement “Denatured Liquid Inedible Egg Product: Not for Human Consumption”
    • The statement “Raw Material Only for the Manufacture of Pet Food”, if applicable
    • The statement “Product sufficiently denatured using [type of denaturant]”
    • Name and address of the origin facility
    • Seal Number
    • Animal health attestations as outlined in section 4, as applicable.
       
  4. Animal Health Attestations
    The Canadian Food Inspection Agency (CFIA) requires a statement attesting that the eggs did not
    originate from a source flock currently under a control zone for Highly Pathogenic Avian Influenza
    (HPAI) or Virulent Newcastle Disease (vND).
    1. For all shell eggs derived from flocks located in states with no current control zones on the AMS
      Shell Egg Export Restrictions List, AMS graders will add the following statement to the remarks
      section of the LP-210S certificate:
      • "I, the undersigned, salaried inspector of the Agricultural Marketing Service (AMS), after due inquiry and to the best of my knowledge, do hereby certify that the poultry or bird products/byproducts within this certificate are exported from the United States, and did not originate in a current CFIA recognized quarantine control zone established due to the detection of highly pathogenic avian influenza (HPAI) or Newcastle disease (ND), as these diseases are defined by the World Organization for Animal Health (OIE).”
    2. For all shell eggs from states containing one or more control zones on the AMS Shell Egg Export
      Restrictions Dashboard, USDA-AMS shall not issue the animal health attestation in remarks described above. Management must obtain VS Form 16-4 from APHIS to accompany the LP-210S with the following remarks:
      • “I, the undersigned salaried veterinarian of the Animal and Plant Health Inspection Service (APHIS), after due inquiry and to the best of my knowledge, do hereby certify that: The poultry or bird products/by-products certified within certificate number (insert number here) are exported from the United States, and did not originate in a current CFIA recognized quarantine control area established due to the detection of highly pathogenic avian influenza (HPAI) or Newcastle disease (ND), as these diseases are defined by the World Organization for Animal Health (OIE).” Upon completion of the form LP-210S and prior to shipment, management must contact their designated APHIS Veterinary Services Service Center for the state(s) in which the layer flock(s) is located. It is the exporter’s responsibility to forward the Shell Egg Grading Certificate, form LP-210S to the applicable APHIS area office to request and secure the VS Form 16-4. Both the VS Form 16-4 and form LP-210S (original with signature in blue ink) must be presented to CFIA authorities at the point of entry to Canada.  View a current directory of APHIS area offices.
